Some dead or dying trees need to be removed from the neighborhood. The Building committee will be notifying homeowners.

We had a large fish die off due last summer and we are now experiencing an extensive algae bloom. Likely due to increased drainage and runoff from fertilized yards.

2. Pulling Algae off the pond has worked and is good organic fertilizer.

Alex Paul, Commissioner
Rob Esposito & Cheryl Page, Treasurer

1. Call to order: at 7:30 PM by presiding President, Denice Steinmann
2. Attendance: Association Board
Home owners: Alex & Sandra Sobol, Kevin & Joleen Knutson, Jeff Finucane (Quorum of 6 needed, 7 total homeowners present, so quorum met)

1. Reading of the meeting agenda: the agenda for the meeting was reviewed with all attendees.

2. Old Business
1. None

3. New Business
1. Review of financials
1. Budget vs actual 2021.
1. Saved more in 2021 due to not sealing roads as we worked on plans for repairs.
2. Group discussed the need to raise dues at some point in order to rebuild road reserve after current project.
2. Overview of accounts (money on hand).
1. $64k in checking, $496.5k in saving. One homeowner has not yet paid. Will reach out again in person in the coming week.
2. Road Repairs Discussion
1. Comcast has applied for permits to move their line. Only once that is done can Bob Newberg begin Phase 1 of road work.
2. Keep Island on Beaver Run? Feeling of group was to get rid of it, but to put outsized weight on homeowners opinions in that immediate vicinity. More of a cosmetic choice.
3. Receptiveness of special assessment in 2023 to ensure Phase 2 done that year? (Not asking for Special Assessment approval at this meeting.) Group was generally receptive to the idea, but not enough people present to get a good sample.
4. Was brought up that if the Board feels dues need to go up, the sooner this is told to homeowners the better. Board would like to at least get through Phase 1 of the roads to have a better idea where finances stand.
3. Board Member Voting
1. Denice & Cheryl terms two-year term ending 2022 (Alex, Sam, Ron two-year terms end 2023)
1. Approved by those present for continued term, with thanks.
4. Questions from attending homeowners or topics for future meetings
1. After roads done, consider ways to slow cars. Stop sign possible at Beaver Run and Clearwater. “Love our kids, please slow down” signs. Speed bumps possible but does add expense as well.
2. Discussed solar on roofs and what that requires
3. Discussed process for getting some homeowners to take better care of property. Helps if neighbors contact the board to complain. Two major areas of improvement we need are driveways and dead tree upkeep.
Motion for adjournment by Denice Steinmann

1. Old Business
1. None

1. New Business
1. Review of financials
1. Actual 2019 financials reviewed
1. YTD results and overview of accounts reviewed (money on hand $441,000)
1. Discussion of the revised covenants and by-laws
1. Background on why covenants were being updated was discussed.
1. Attorney Chuck VanderVennet was available to answer any questions. None were asked on the call from participants.
1. Action: Presuming that questions emailed in prior to the call are answered to the Board’s satisfaction, all Homeowners will receive voting sheets after the meeting.
1. Possible Road Widening
1. Topography project with Creaney Engineering was explained. Final report is expected in the next two weeks. This will allow the Board to ask contractors for more precise estimates on the work required.
1. Board will request bids from contractors to widen Beaver Run and Clearwater, or to widen all BCE roads. Based on initial bids received last year, the Board believes that widening all roads would require a special assessment that would need to be approved by the Homeowners.
1. Some homeowners in attendance expressed a desire for a vote by all Homeowners on whether any roads should be widened, believing that any large capital expenditure should be approved by majority vote.
1. The Board declined to commit to this route. The Board is charged with making capital spending decisions and is not relinquishing that role. The Board decisions will be based on whether a proposed project is both affordable and advantageous to the Homeowners. Only a special assessment is subject to Homeowner vote.
1. Activity on vacant lot at 3934 Lakeview Court was brought up as a new topic
1. A question arose as to whether the extensive work being done on the vacant lot would ensure that it would now drain as intended.
1. Alex Paul responded that the Board could not make any promises as to the effectiveness of the drainage or grading. The Homeowner has taken commendable steps to ensure that both the safety and appearance of the Lot were much improved, and those were the Board’s primary concerns. While some piping debris still needs to be removed, in the Board’s opinion, the Homeowner has made huge steps to ensure that the Lot is safer and more attractive.
1. Private Drive entrance clean-up and broken bench removal is completed.
1. Broken stop sign post at corner of Beaver Run and Clearwater is supposed to be replaced soon (this week or next).
1. Introduced Joseph Hwang, the new owner of 3929 Forest Fork as of last week.
1. Motion was passed to send a letter to the bank owning 3944 Lakeview Court to improve the lawn mowing and upkeep of the exterior of this property. Failure to do so would result in the HOA doing the work and billing it to the bank.
1. Discussion on neighborhood Building Committee role was introduced as a new topic.
1. Several Homeowners expressed displeasure with specific decorative choice made by another Homeowner, and they inquired if the HOA could require its removal.
1. Other Homeowners argued that it was not explicitly against the rules, and whether or not it was to their taste, it was allowed.
1. Building Committee members in attendance (2 of 3) agreed we should reach out to this Homeowner and let them know that some Homeowners are concerned that this decoration may lower the perceived value of the neighborhood, and then determine the Homeowner’s reaction before any next decision is made.
1. Denice & Cheryl terms two-year term ending 2020 (Alex, Sam, Ron two-year terms end 2021).
1. Hyung Kim expressed a desire to join the HOA Board. No current Board Members in attendance expressed a desire to step down. This was the first time in memory we had a situation where the BCE Board had more nominees for positions than we had openings. We were therefore unprepared for this, and we were uncertain how to proceed. Therefore, we may be calling another meeting in the near future to determine a vote for the two Board seats up for election this year.
1. Additional questions from attending Homeowners or topics for future meetings
1. No other topics were raised.
1. Motion for adjournment by Alex Paul. Seconded by Denice Steinmann.

A vote was taken. Sam and Ariv were approved, with Alex as an alternate. The Board will meet to decide which role each will serve.

2. Treasurer Phil Mondrowski provided and explained the profit and loss statement, as well as the need for an Escrow account for the new home construction at 3915 Beaver Run. He also presented the 2017 budget. The financials were unanimously approved. Phil is also collecting contact information for a neighborhood directory. Several homeowners have asked for this. Everyone will have a choice to either be included or opt out. The resulting directory will only be shared with those who have chosen to be included.

3. An update on the Roads fund was given. Based on a 12 year road replacement estimate, we are 60% of the way to our target budget. Given the time remaining, we should be able to replace the roads without a special assessment.

4. We’ll be moving ahead with the following projects in 2017:
· Redoing the landscaping and electrical of our Common area entranceways and the two “islands” on Beaver Run and Lakeview Drive.
· Replacement of the broken lightpole at the Beaver Run entrance.
· Further dead tree removal as needed.
· We are waiting on 4 bids requested for landscape maintenance and road snowplowing. There was some concern expressed by those who have been happy with Mr. Braulio who has been doing a good job for many years. The Board felt that his prices may have climbed too high over the years, and that it was financially prudent to solicit other bids. The Board will take his reliability into consideration when we make our decision.
· We discussed the issue of trees planted between the ditches and the roads, and decided that we should not allow any new trees to be planted there in the future.

5. There was discussion about algae build-up in the ponds, and what could be done about it. Bubblers or chemicals were mentioned. The board suggested that the affected homeowners investigate and possibly present some options to the board.

6. We’ve had complaints about a dog roaming in the neighborhood, digging and doing his business in other homeowner’s yards. We discussed a possible need to add to the bylaws to address this.

7. We discussed the lack of necessary repairs, maintenance and general upkeep of some of the neighborhood homes. Our covenants require responsible maintenance, and keeping our home and property in good repair, condition and appearance. Everyone agreed that the board should begin to address these issues and give notice to those homeowners who are not complying. Specific requirements will be addressed. It is in all of our best interests to have a beautiful well kept neighborhood.

8. The Board will meet to set a date for the next annual meeting and neighborhood clean-up. A notice will be sent out to everyone with those dates.
The meeting was adjourned at 8:31pm.
Faithfully submitted,
Denice Steinmann]]>

1. Call to Order:

2. Open Issues
1. Volunteers for board positions
We are currently without a treasurer and in need of another VP and possible road administrator. Call for volunteers made to those present-Phil Mondrowski volunteered for treasurer position.
2. Vote in new members : Nomination of Phil Mondrowski for treasurer made by Denice Steinmann and seconded by Alex Paul. All in attendance in favor of Phil Mondrowski being appointed treasurer for the 2016 year.

1. Financials- see attached financial report. We are putting in about 50K each year to reserve acct for roads.. 2 assessments not paid from last year-one in foreclosure. One outstanding bill for snow plow in January not reported on this report. Snow plow normally around 10-20K range-this was normal for last year and should be lower this year. Discussion ensued about whether we should increase association dues and it was explained that we projected increase because we did not have volunteers for the board and would have possibly needed to outsource management firm for board. It was noted that no increase would be necessary at this point in assessments as we now have at least one volunteer for the board. Discussion ensued about management companies and the general thought was that we would not need/want an outside company to manage the HOA because of increased costs and their interest not being there.
Vote on dues staying current at $1200 per household. All in attendance in favor of dues staying at current $1200 level.

2. New Business
1. By laws enforcement and penalties: Discussion in regards to how to enforce the rules we already have in place. Discussion about properties going into foreclosure and how to deal with these properties.
2. Road improvements: Bob Ihmels commented that he would look into road improvements and communicate this to the board. We have estimated 10K for patching at this point on current financials. Bob will get 3 estimates and present to board.
3. Landscape concerns: Dead tree in middle of Beaver Run-we will not be planting tree again. Will ask Braulio to remove and possibly include this in paving once we begin that project. Discussion was heard from Larry Buettner regarding dead trees in swales, some of which he claimed were owned by association. Larry’s recommendation was to send a notification to the owner and give a date to have tree out or trimmed by and then fine the owner. Discussion ensued about which trees could be removed and how owners would be notified. Alex Paul volunteered to contact tree company to have them take care of dead trees. Discussed putting together a document of standards for trees, etc to be mailed with assessments this year. This letter will note a date by which the association would like to see improvements done by. In early spring then, a letter can go to specific homeowners who have not resolved the issues with their landscaping by that date listed, with pricing we’ve put together with a specific tree removal /trimming company. It was recommended by Larry that a deadline of June 1 to be made before fining begins from HOA. Discussion ensued regarding reflectors or snow markers and that we have by laws that state nothing can be in the swale. This same notation could be put into assessment inclusion letter and again, within a deadline they will be removed and if they are put up again, fines will ensue. Larry also brought up that there are trees in entranceways that may be dead-discussion made that Braulio could be contacted to remove dead trees and replace what needs replacing in entranceways.Discussion made to switch lighting at entrance as well to LED. Larry will ask Braulio as well about entranceways and lighting. Discussion brought up that we would like to widen roads when they need to be redone again in another 5-6 years so as to avoid these same issues with damage from year to year. Brought up that we may want to consider concrete edging to prevent damage but space becomes an issue because of topography.

1. Open for new items or comments
New item: welcome letter on website needs to be changed to reflect current info.
New item: by laws indicate meetings in May only and at some point the meeting was moved to Feb date. Do we think moving the annual meeting date to May would be appropriate? General thought was that Jan./Feb. date was more appropriate for budgeting concerns.
New item: perhaps a yearly social event would help to bring neighborhood together. We could put this into the assessment letter as well with a date in mind for the summer.
One question: how do you contact the board? There are individual emails listed on the website -one neighbor has tried to contact the board and did not get a response.

2. Housekeeping
1. Date for clean up 2016: Saturday April 16th with April 23rd as rain date
2. Date for next meeting: Feb 9th 2017. 7pm at village hall.

1. Adjournment

2. Vote in new trustee-Sujeeva Seneviratne-Treasurer

Both new trustees approved and seconded during meeting.

1. Financials
We currently have one year reserve. No foreclosures this year. Will plan on keeping ahead of foreclosures to avoid losing funds. Will discuss at 2016 meeting the possibility of amending bylaws to include wording to keep one years reserve in account.
Light issues: will continue to work on getting mailbox lighting universal. Should work in lighting to landscape committee. Steven Kotarinos volunteered for heading landscape committee.

New business
1. Tree trimming and grass mowing
Last year we notified owners that if trees were overhanging they could take care of it themselves within a time frame or Braulio would take care of it afer the designated time at cost to the homeowner. Propsed getting quote for trimming again this year. Ask Braulio to include dead trees in lots for owners to decide on perhaps having removed. Same process with mowing side areas that block vision in intersections. Letter would go to owner and if not taken care of, we will have it mowed and cost forwarded to owner. Recommend including language about removing snow markers at spring clean up time as general rule.
2. Volunteers for road committee
-road repair and patching:
-private drive seal coating: driveway type material needed
-culverts: assess repair of this and condition( those under roads-not those under driveways)
Do we have volunteers for road committee?
3. Covenants and bylaws updates
We do not have a building committee and if we have someone want to build on a lot we will need such committee. This person would look over regulations, by laws to make sure all are up to date insofar as trucks, etc in the event that someone does want to build at this point. Will also look at wear and tear on roads, schedules of costs upon building/renovating.

Vote on keeping assessements same at $1200. Vote was unanimous to keep the same for 2015/16.

4. Landscape committee
Plan for costs-meet back for approval. Come back with plan and quote out companies and coordinate lighting at same time. Denise and Bob will head this up.
5. Sign post protection
Wrap bottoms to prevent thinning once weather breaks. Denise has this and will check fit in spring.
1. Open for New items or comments
Website proposal for neighborhood. Do we want to get policies, etc online? Do we want all owners and info online who want to be? Additions to webpage? Kevin and Sujeeva volunteer to help out with looking into this. Our website is beavercreekestates.org.
